释义	法律分析：缓刑和缓期执行，虽然看起来很相似，但是两个完全不同的概念。缓刑是被判处拘役或者是三年以下有期徒刑，缓期执行也称死刑缓期执行。也可以叫做死缓。对可判处死刑的犯罪分子，可以不用立即执行的，能在判处死刑的同时也宣告死刑缓期二年执行。法律依据：《中华人民共和国刑法》第七十六条被宣告缓刑的犯罪分子，在缓刑考验期限内，由公安机关考察，所在单位或者基层组织予以配合，如果没有本法第七十七条规定的情形，缓刑考验期满，原判的刑罚就不再执行，并公开予以宣告。
