释义	法律主观：根据1994年出台的两高的司法解释规定，贩卖假的毒品需要区分知情与否。 1：如果明知是假毒品而贩卖的，涉嫌构成诈骗罪。 2：如果不知是假毒品而贩卖的，涉嫌构成贩毒罪。 3：法律适用最高人民法院《关于适用全国人民代表大会常务委员会关于禁毒的决定》的若干问题的解释中第十七条第一款规定：对以假毒品进行犯罪的定性，明知是假毒品而冒充毒品贩卖的，以诈骗罪定罪处罚。不知道是假毒品而当作毒品走私、贩卖、运输、窝藏的，应当以走私、贩卖、运输、窝藏毒品犯罪 (未遂)定罪处罚。
