问题	合同的效力与合同的成立一样吗
释义	合同是否已经履行不影响居间报酬的支付。居间合同的居间人只作为委托人与第三人之间签订合同的介绍人，自己一般不直接参与订立合同，居间人既不是代理人，又非当事人和保证人，他不能保证合同双方一定履行合同。居间行为所介绍的当事人之间合同一经成立，居间人的作用即结束，因此，不能要求把合同履行作为支付居间报酬的条件。在合同的类型当中，购房合同算是比较特殊的了。其在双方当事人签字盖章后就会成立，但想要其生效的话，则必须到房管部门办理登记备案，否则的话，其就没有生效。
