释义	申请劳动仲裁的程序是递交劳动仲裁申请书及相关证据申请书符合要求的，仲裁委员会自收到申请书之日起5日内做出受理或者不予受理的决定，决议受理的，应当自作出决议之日起五日内将申述书副本送达被请求人。申请劳动仲裁的材料是：1.提供相应的能证明仲裁请求的证据材料；2.仲裁当事人可以委托一至二名律师或者其他人代理参加仲裁活动；3.申诉书以及申诉人和被申诉人的身份证明材料。根据《劳动争议调解仲裁法》第三条，解决劳动争议，应当根据事实，遵循合法、公正、及时、着重调解的原则，依法保护当事人的合法权益。
