喝酒死人同桌人要负法律责任吗？ |

喝酒死人同桌人如果具有先行义务行为，如劝酒、灌酒等，是需要承担侵权责任的。但如果是喝酒者自己不听劝阻、执意喝酒的，则同桌人不承担侵权责任，由受害者自己承担。
一、经常劝酒的朋友发生交通事故要承担什么责任
以下情形劝酒需承担法律责任：强迫性劝酒或在对方已喝醉、意识不清、没有自制力的情况下，仍劝其喝酒的行为；明知对方不能喝酒仍劝其饮酒的情形，如明知对方身体状况，仍劝其饮酒诱发疾病等；未将醉酒者安全护送，如饮酒者已失去或即将失去对自己的控制能力，神志不清无法支配自身行为时，没有将其送至医院或安全送回家中；酒后驾车未劝阻导致发生交通事故等损害的。
二、喝酒发生交通事故同桌酒友担责么
喝酒发生交通事故，同桌酒友有下列情况的，承担连带责任：
一、强迫性劝酒，或者在对方已喝醉，意识不清，没有自制力的情况下，仍劝其喝酒的行为。
二、明知对方不能喝酒，如明知对方的身体状况，仍劝其饮酒诱发疾病等。
三、未将醉酒者安全送达。
四、酒后驾车未劝阻。
能够证明席间曾阻止驾驶员喝酒，并劝告驾驶员不要开车的不承担责任。
