释义	预备役人员战时拒绝、逃避征召或者军事训练，涉嫌下列情形之一的，应予立案追诉：（一）无正当理由经教育仍拒绝、逃避征召或者军事训练的；（二）以暴力、威胁、欺骗等手段，或者采取自伤、自残等方式拒绝、逃避征召或者军事训练的；（三）联络、煽动他人共同拒绝、逃避征召或者军事训练的；（四）其他情节严重的情形。法律依据《最高人民检察院、公安部关于公安机关管辖的刑事案件立案追诉标准的规定(一)》第95条
