释义	借条和欠条本身是不构成诈骗罪的。不过诈骗犯可能利用借条诈骗，借款时虽然打了借条，看起来是合法借贷关系，实际上是根本不打算还款的，虽然是诈骗，但是，定诈骗罪还是很难的，除非借款人数众多、借款数额巨大，到期不还款跑路，才可以定诈骗罪。借条合同诈骗的特点：一是行为人有非法占有对方当事人财物的目的;二是行为人在签订、履行合同过程中采用了欺诈手段;三是合同诈骗必须达到数额较大，才构成犯罪。法律依据《中华人民共和国刑法》第二百二十四条
