释义	不赡养老人，如果造成严重后果的，司法机关会定遗弃罪。但是如果有其他的成年子女在赡养父母，那自己不赡养父母就不会造成严重的后果就不会构成犯罪。如果没有其他子女照顾年老的父母，自己也不赡养父母，导致父母生活困难有严重后果的就会被判刑。法律依据: 《中华人民共和国民法典》第一千零六十七条父母不履行抚养义务的，未成年子女或者不能独立生活的成年子女，有要求父母给付抚养费的权利。成年子女不履行赡养义务的，缺乏劳动能力或者生活困难的父母，有要求成年子女给付赡养费的权利。
