释义	对保证人的法律规定： 1、具有代为清偿债务能力的法人、其他组织和公民，可以作保证人。 2、从事经营活动的事业单位、社会团体为保证人的，如无其他导致保证合同无效的情况，其所签定的保证合同应当认定为有效。 3、国家机关在接受外国政府或者国际经济组织提供的贷款的过程中，并经国务院批准后可以作为保证人。【法律依据】《民法典》第六百八十三条机关法人不得为保证人，但是经国务院批准为使用外国政府或者国际经济组织贷款进行转贷的除外。以公益为目的的非营利法人、非法人组织不得为保证人。
