释义	缓刑，全称暂缓量刑，也称为缓量刑，是指对触犯刑律，经法定程序确认已构成犯罪、应受刑罚处罚的行为人，先行宣告定罪，暂不执行所判处的刑罚。缓刑由特定的考察机构在一定的考验期限内对罪犯进行考察，并根据罪犯在考验期间内的表现，依法决定是否适用具体刑罚的一种制度。对宣告缓刑的犯罪分子，在缓刑考验期限内，依法实行社区矫正，如果没有刑法第七十七条规定的情形，缓刑考验期满，原判的刑罚就不再执行，并公开予以宣告。
