释义	法律分析：动迁房买卖由于动迁房（所谓动迁房又称动拆迁安置房，是指因城市规划、土地开发等原因进行拆迁，而安置给被拆迁人或承租人居住使用的房屋）安置的对象是特定的动拆迁安置人，除受相关法律、法规的规范之外，还受到当地政府相关的地方性政策的约束。所以和一般的商品房交易有很大的不同法律依据：《国有土地上房屋征收与补偿条例》第十八条征收个人住宅，被征收人符合住房保障条件的，作出房屋征收决定的市、县级人民政府应当优先给予住房保障。具体办法由省、自治区、直辖市制定等等。
