释义	好意同乘是指机动车驾驶人主观上出于好意而无偿搭载他人,从行为的客观上看,车辆驾驶人不向同乘者收取任何费用而搭乘他人是一种好意施惠的行为,如果搭乘人需要向驾驶人支付报酬,应该认为是双方的一种“有偿”合同关系,应当由民法典合同编的相应规则予以调整。法律依据：《中华人民共和国民法典》第一千二百一十七条非营运机动车发生交通事故造成无偿搭乘人损害,属于该机动车一方责任的,应当减轻其赔偿责任,但是机动车使用人有故意或者重大过失的除外。
