工龄起止如何计算

释义

法律主观：

年假是与工龄挂钩的。年假一般按照下面的标准计算：职工的工作时间累计一到十年的，年休假为5天；累计工作时间满10年不满20年的，年休假10天；累计工作时间已满20年的，年休假15天。国家法定休假日、休息日不计入年休假的假期。

法律客观：

《劳动保险条例实施细则》第三十八条，一般工龄系指工人职员以工资收入为生活资料之全部或主要来源的工作时间而言。在计算一般工龄时，应包括本企业工龄在内。
