释义	债务转移的生效条件：第一，须有原债务人与新债务人之间达成的债务移转合同;第二，须经债权人的同意，即原债务人与第三人订立债务承担(移转)的合同，由第三人代替原债务人履行债务，须经债权人同意，才生效力，即免去原债务人的义务;第三，一般，须所承担(移转)的债务具有可移转性，对于债务人必须亲自履行的债务，如技术服务合同中指定具有一定技术水平等特殊身份的技术人员履行的合同，不得将债务移转。《合同法》第八十四条规定，债务人将合同的义务全部或者部分转移给第三人的，应当经债权人同意。
