释义	法律分析：不处罚。因证据不足又放了涉嫌醉驾的犯罪嫌疑人的做法是完全合理的,因为《刑事诉讼法》第163条当中规定,如果在侦查过程当中发现证据不足,不应该追究犯罪嫌疑人的刑事责任的,应该撤销案件,对于公安机关已经逮捕的犯罪嫌疑人,在证据不足的情况下必须必须马上释放。法律依据：《中华人民共和国刑事诉讼法》第一百六十三条在侦查过程中，发现不应对犯罪嫌疑人追究刑事责任的，应当撤销案件;犯罪嫌疑人已被逮捕的，应当立即释放，发给释放证明，并且通知原批准逮捕的人民检察院。
