释义	农民工发生事故伤害后，用人单位应及时的将伤者送到工伤保险的定点医疗机构救治，并在24小时内向劳动保障行政部门和经办机构备案。农民工所在单位应当自事故之日或者被诊断为职业病之日起30日内，向市区县劳动保障行政部门提出工伤认定申请。如用人单位未按规定提出工伤认定申请的，工伤职工或亲属可以在一年内直接向劳动保障行政部门提出工伤认定申请，用人单位不认为是工伤的，由用人单位承担举证责任。
