法律分析：
一般情况下，城市管理部门在尚未经当地人民政府授权责成的情况下，并无职权直接对违法建筑进行强拆，所以此时城管的强拆行为，即使是针对违建，这也是可以认定为违法的。反之，若是赋予了强拆的权利，那么就可以对违法建筑强拆，不过在强拆的时候也要注意方式方法。
法律依据：
《中华人民共和国城乡规划法》 第六十五条 在乡、村庄规划区内未依法取得乡村建设规划许可证或者未按照乡村建设规划许可证的规定进行建设的，由乡、镇人民政府责令停止建设、限期改正期不改正的，可以拆除。
