释义	国家对待未成年人犯罪在这方面有明确规定。被司法机关采取强制措施的在校未成年学生，在法院判决生效前，学校不得取消其学籍；判决生效后，被判处缓刑、管制、免刑、单处罚金等非监禁刑的，也不得取消其学籍；在取保候审期间，不得责令其停课。如判刑时处于升学年级，也应与其他在校学生享受同等的招生政策。但是对于大学生刑事犯罪缓刑的，国家并无明确的法律规定，各个学校由其本校的规章制度决定处理。
