释义	未经同意而使用他人肖像。侵犯肖像权须是以营利为目的的行为。以营利为目的是指以使用某人的肖像达到招揽顾客、推销商品的目的或直接以肖像制作成为或复制成为商品出售盈利。未经他人同意而以营利为目的使用他人肖像，既损害了权利人的人格，也损害了权利人因他人利用自己的肖像进行商业行为而获取物质利益的权利，这在法律上是不许可的。法律依据：《民法典》第一百一十条：自然人享有生命权、身体权、健康权、姓名权、肖像权、名誉权、荣誉权、隐私权、婚姻自主权等权利。
