释义	撤销权属于形成诉权，必须通过法院或者仲裁机构行使。债权人行使撤销权，既可以根据双方的约定，到仲裁委员会申请仲裁，也可以到法院起诉。如果双方没有约定仲裁，就必须到法院起诉，要求撤销合同。法律依据《民法典》第一百四十七条，基于重大误解实施的民事法律行为，行为人有权请求人民法院或者仲裁机构予以撤销。
