释义	法律分析：一般保证的债权人向债务人和保证人一并提起诉讼的，人民法院可以将债务人和保证人列为共同被告参加诉讼。但是，应当在判决书中明确在对债务人财产依法强制执行后仍不能履行债务时，由保证人承担保证责任。法律依据：《中华人民共和国民法典》第三百八十六条担保物权人在债务人不履行到期债务或者发生当事人约定的实现担保物权的情形，依法享有就担保财产优先受偿的权利，但是法律另有规定的除外。
