释义	不满16岁算童工，任何企业事业单位、个体工商户如果招用十六周岁的未成年人从事劳动的，是招用童工性质，属于违法行为。凡用人单位使用童工的，由劳动保障行政部门按照每使用一名童工每月处5000元罚款的标准给予处罚。法律依据：《中华人民共和国未成年工特殊保护规定》第二条未成年工是指年满十六周岁，未满十八周岁的劳动者。未成年工的特殊保护是针对未成年工处于生长发育期的特点，以及接受义务教育的需要，采取的特殊劳动保护措施。
