释义	合同到期不续约，一般情况下劳动者提前一个月以书面的形式通知用人单位就可以解除劳动关系；如果用人单位存在《劳动合同法》第38条规定的情形，劳动者可以被迫辞职，不需要等一个月，并且可以要求用人单位支付经济补偿金。用人单位在合同到期以后，不续签的，超过一个月劳动者可以要求用人单位支付双倍工资。从法律上来讲，合同到期需提前一个月离职的，不过其实我国劳动合同法虽然规定了必须提前一个月通知，但实际情况还是以用人单位和劳动者协商而定。
