如何处理商品房有瑕疵的情况

法律分析：
商品房如果存在瑕疵，购房人可以向开发商提出意见，开发商承担维修责任，直到房屋质量没有问题可以交房。如果开发商一直不处理房屋瑕疵问题，可以向法院起诉，要求开发商承担违约责任。
法律依据
《商品房销售管理办法》 第三十五条
规定，商品房交付使用后，买受人认为主体结构质量不合格的，可以依照有关规定委托工程质量检测机构重新核验。经核验，确属主体结构质量不合格的，买受人有权退房；
给买受人造成损失的，房地产开发企业应当依法承担赔偿责任。
