法律主观：

劳动法关于调岗的规定如下： 1、如果单位未与劳动者协商一致的情况下，对岗位进行重大调整，则劳动者有权拒绝； 2、如果单位因此而单方面与劳动者解除劳动合同，则属于违法解除劳动合同，应当支付赔偿金。

法律客观：

《工资支付暂行规定》第十三条用人单位安排劳动者工作的，按照不低于劳动合同规定的劳动者本人日或小时工资标准的300%支付劳动者工资。用人单位安排劳动者法定假日工作的，不得调休。
