释义	法律分析: 行使外交保护的条件是： 1.本国国民的合法权益因所在国的国际不当行为而受到损害； 2.受害人自受害之日到抗议或求偿结束之日须持续具有本国国籍，且一般不能具有所在国的国籍； 3.受害人须以用尽当地救济（办法）且未能获得合理补偿，即已用尽当地救济。《中华人民共和国刑法》第八条外国人在中华人民共和国领域外对中华人民共和国国家或者公民犯罪，而按本法规定的最低刑为三年以上有期徒刑的，可以适用本法，但是按照犯罪地的法律不受处罚的除外。
