释义	本罪在主观方面表现为故意即行为人明知自己虐待俘虏的行为破坏了俘虏管理秩序，将会对我军作战造成危害，却希望或者放任这种危害结果发生。过失不构成本罪。虐待俘虏的动机多为义愤、敌意和报复心理，不论出于何种动机，情节恶劣的均构成虐待俘虏罪。《刑法》四百四十八条：虐待俘虏，情节恶劣的，处三年以下有期徒刑。
