法律分析：企业的转让，如果该企业拥有债务的，应该先通知债权人，征求债权人的同意，如果债权人不同意的，应当由债务人提供担保以后，方可转让，否则转让行为对债权人无效。
法律依据：《中华人民共和国民法通则》 第四十四条规定 企业法人分立、合并或者其他重要事项变更，应当向登记机关办理登记并公告。企业法人分立、合并，它的权利和义务由变更后的法人享有和承担。
