问题	什么叫非法高利贷
释义	高利贷涉嫌违法但不犯罪。高利贷违法的意思其实就是说，超过银行利率4倍的话，超出部分不受法律保护而已。对于高利贷高出法律规定的利息部分，应该是无效约定，这不会得到法律支持。超出4倍的利息并不属于非法收入，只要借贷双方不就此提起诉讼，可以视为资金出借方的合法收入。法律依据：《最高人民法院关于审理民间借贷案件适用法律若干问题的规定》第二十六条规定，借贷双方约定的利率未超过年利率24%，出借人请求借款人按照约定的利率支付利息的，人民法院应予支持。
