释义	法律分析：妻子是可以向丈夫的婚外情人进行索赔的，但是只能索赔丈夫给予婚外情人的财产。如果想得到精神损害方面的赔偿，是不行的。过错损害赔偿责任的主体，只能是离婚诉讼当事人中无过错方的配偶。也就是说，妻子只能在离婚的时候起诉出轨的丈夫，而不能告婚外情的情人。法律依据：《中华人民共和国民法典》第一千零九十一条有下列情形之一，导致离婚的，无过错方有权请求损害赔偿：（一）重婚；（二）与他人同居；（三）实施家庭暴力；（四）虐待、遗弃家庭成员；（五）有其他重大过错。
