释义	法律分析: 不论谁先动手，只要有殴打他人的行为并造成一定危害，就可以依照治安管理处罚法第四十三条进行处罚。如果是因为民间纠纷引起的打架斗殴公安机关可以依照治安管理处罚法第九条进行调解，当事人达成协议的，不予处罚。法律依据: 《中华人民共和国刑事诉讼法》第五十一条公诉案件中被告人有罪的举证责任由人民检察院承担，自诉案件中被告人有罪的举证责任由自诉人承担。
