释义	《环境保护法》第六十四条规定，因污染环境和破坏生态造成损害的，应当依照《中华人民共和国侵权责任法》的有关规定承担侵权责任。因环境污染损害而产生的赔偿纠纷，当事人可请求行政机关进行调解处理。第六十五条规定，环境影响评价机构、环境监测机构以及从事环境监测设备和防治污染设施维护、运营的机构，在有关环境服务活动中弄虚作假，对造成的环境污染和生态破坏负有责任的，除依照有关法律法规规定予以处罚外，还应当与造成环境污染和生态破坏的其他责任者承担连带责任。
