夫妻婚内赠与离婚时分割：
(一)自行协商
如果夫妻是通过协商的方式解决离婚财产分割问题的，那么对于夫妻婚内赠与离婚如何分割，完全有夫妻双方协商确定，可以分割，也可以不分割。但是离婚财产分割协议生效以后，夫妻必须严格履行协议的内容。
(二)诉讼解决
如果夫妻起诉解决离婚财产分割的问题，那么按照法律规定，法院则会对夫妻共同财产平均分割。
一、孩子抚养权算不算财产分割
孩子抚养权不算财产分割，具体如下：
1，孩子抚养权是指夫妻双方对未成年子女抚养、教育和保护的权利，而财产分割是要在离婚时分割夫妻共同财产，孩子抚养权不属于夫妻共同财产；
2、离婚财产分割主要有离婚财产分割协议和请求法院判决分割财产，离婚财产分割协议是指当事人通过订立协议和平友好地分割财产，没有纠纷，另一种是当事人在离婚时就财产分割产生重大分歧时，请求法院判决分割财产。
二、夫妻共同财产限价房如何分割
夫妻共同财产限价房应该平均分割。因为限价房是夫妻的共同财产，双方离婚是，可以先进行协商，如果协商通过的话，就按照双方协商内容对房产进行分割。如果双方协议不成立，那么需要按照法律进行平均分割。不管是什么财产，只要是属于夫妻的共同财产，在双方离婚时，都要平均分割。当然根据实际情况，离婚后如果一方负责的义务比较大，可以协商给其多一些财产。
