民法典之民法总则六项基本原则

释义

法律主观：

民法总则的基本原则有： 1、平等原则； 2、自愿原则； 3、公平原则； 4、诚信原则； 5、绿色原则； 6、公序良俗原则；公序良俗是由“公共秩序”和“善良风俗”两个概念构成。

法律客观：

《民法典》第一条为了保护民事主体的合法权益，调整民事关系，维护社会和经济秩序，适应中国特色社会主义发展要求，弘扬社会主义核心价值观，根据宪法，制定本法。第二条民法调整平等主体的自然人、法人和非法人组织之间的人身关系和财产关系。
