遗弃应负什么法律责任
释义
在家庭中负有赡养、抚养和扶养义务的人,对需要赡养、抚养和扶养的人不履行应尽的义务。遗弃情节恶劣的,根据《刑法》遗弃罪的规定,处五年以下有期徒刑、拘役或者管制。对遗弃家庭成员,受害人根据《民法典》的规定提出请求的,人民法院应当依法作出支付扶养费、抚养费、赡养费的判决。
【法律依据】
《刑法》第二百六十一条，对于年老、年幼、患病或者其他没有独立生活能力的人，负有扶养义务而拒绝扶养，情节恶劣的，处五年以下有期徒刑、拘役或者管制。
