2、诉讼离婚的，想离婚的一方应当准备离婚诉状、结婚证，证明夫妻关系破裂的证据应当向对方住所地法院提起诉讼。
协议离婚的条件如下：
1、双方当事人须为有完全民事行为能力人且有合法的夫妻身份；
2、当事人双方必须有离婚的合意，即两人自愿达成离婚的意思表示一致；
3、协议离婚必须对夫妻共同财产的分割作出适当的处理；
4、协议离婚时双方必须对子女的抚养作出妥善安排；
5、离婚协议必须不能违反公序良俗和法律强制性规定。
法律依据：《中华人民共和国民法典》第一千零七十六条
夫妻双方自愿离婚的，应当签订书面离婚协议，并亲自到婚姻登记机关申请离婚登记。
离婚协议应当载明双方自愿离婚的意思表示和对子女抚养、财产以及债务处理等事项协商一致的意见。
