释义	法律分析：由人民法院依法执行。法律依据：《中华人民共和国刑事诉讼法》第三百条人民法院经审理，对经查证属于违法所得及其他涉案财产，除依法返还被害人的以外，应当裁定予以没收。对不属于应当追缴的财产的，应当裁定驳回申请，解除查封、扣押、冻结措施。对于人民法院依照前款规定作出的裁定，犯罪嫌疑人、被告人的近亲属和其他利害关系人或者人民检察院可以提出上诉、抗诉。
