释义	累犯处罚注意事项有对累犯必须从重处罚，对于累犯应当比照初犯、偶犯或其他犯罪人从重处罚，从重处罚时，必须根据其所实施的犯罪行为的性质、情节和社会危害程度，确定具体应判处的刑罚。对于累犯不适用缓刑和假释。【法律依据】《中华人民共和国刑法》第八十一条第二款累犯以及因故意杀人、强奸、抢劫、绑架、放火、爆炸、投放危险物质或者有组织的暴力性犯罪被判处十年以上有期徒刑、无期徒刑的犯罪分子，不得假释。第七十四条对于累犯和犯罪集团的首要分子，不适用缓刑。
