释义	法律分析：刑事拘留的时间是可以抵扣刑期的，因为刑事拘留也是限制了当事人的人身自由，跟后期判处的有期徒刑的目的和效果都是一样的，所以，之前被刑事拘留的期限在后期都会折抵所判处的刑期的。司法机关在处理的时候都会记录在册，这也是法律制度上明确规定的。法律依据：《中华人民共和国刑事诉讼法》第八十六条公安机关对被拘留的人，应当在拘留后的二十四小时以内进行讯问。在发现不应当拘留的时候，必须立即释放，发给释放证明。
