释义	法律分析：需要根据双方签订的劳动合同来看。用人单位安排劳动者上夜班不违法,劳动者有服从安排的义务,但劳动合同约定了不上夜班的除外。单位虽然有权利根据工作需要变更劳动者的工作岗位，但是应当同劳动者协商，并取得劳动者的同意。至于白班和夜班或者三班倒这样的特殊事宜应当在劳动合同中予以体现。法律依据：《中华人民共和国劳动合同法》第七十九条发生劳动争议后，当事人应当先向劳动争议仲裁委员会申请仲裁，对仲裁裁决不服的，可以向人民法院提起诉讼。
