释义	法律分析：根据我国刑法规定，通常情况下，七十五周岁以上的老人犯罪，不会适用死刑且可以从轻、减轻处罚，对于审判的时候年龄已经满七十五周岁的人，也不会适用死刑，但是用特别残忍的手段导致人死亡的除外。法律依据：《中华人民共和国刑法》第十七条之一已满七十五周岁的人故意犯罪的，可以从轻或者减轻处罚；过失犯罪的，应当从轻或者减轻处罚。第四十九条犯罪的时候不满十八周岁的人和审判的时候怀孕的妇女，不适用死刑。审判的时候已满七十五周岁的人，不适用死刑，但以特别残忍手段致人死亡的除外。
