释义	法律分析：犯法，不一定犯重婚罪。如果以夫妻名义同居，构成重婚罪。重婚罪有两种情形：一是，有配偶者又与他人登记结婚，或者明知他人有配偶而与之登记结婚；二是，有配偶者与他人以夫妻名义同居生活，或者明知他人有配偶而与之以夫妻名义同居生活。如果尚未解除婚姻关系，与婚外异性以夫妻名义公开同居，则构成事实重婚，应追究重婚罪的刑事责任，依法处2年以下有期徒刑或者拘役。法律依据：《中华人民共和国刑法》第二百五十八条有配偶而重婚的，或者明知他人有配偶而与之结婚的，处二年以下有期徒刑或者拘役。
