释义	律师解答：一般要有原合同的形式相一致。如原合同为书面形式，变更合同也应采取书面形式，如原合同为口头形式变更合同，则既可以采用口头形式，也可以采取书面的形式。如果当事人在法律行政法规规定变更合同应当办理批准登记的手续的情况下，为遵守这些规定，即便达成了变更合同的协议也是无效的。【法律依据】：《中华人民共和国民法典》第五百四十三条当事人协商一致，可以变更合同。第五百四十四条当事人对合同变更的内容约定不明确的，推定为未变更。
