一、过失犯罪的两种心理状态是怎样的？
1、过失犯罪心理的两种状态如下：
（1）疏忽大意的心理状态；疏忽大意的心理状态，这类指行为人应当预见并且也能够预见自己的行为可能发生危害社会的结果，但是由于种种原因而没有预见到危险因素的存在；
（2）过于自信的心理状态；心理上缺乏应付危险的准备性，因而在危险发生时，不能加以正确的判断，也无法采取恰当有效的措施制止或避免危害结果的发生，从而构成了疏忽大意的过失犯罪。
2、法律依据：《中华人民共和国刑法》第十五条
应当预见自己的行为可能发生危害社会的结果，因为疏忽大意而没有预见，或者已经预见而轻信能够避免，以致发生这种结果的，是过失犯罪。过失犯罪，法律有规定的才负刑事责任。
二、状态犯与继续犯的区别？
1、继续犯与状态犯，都有不法状态继续，即在时间上表现为继续的特点；
2、两者的意义不同。继续犯的不法状态，是与其行为同时处于继续之中，而状态犯只有不法状态的继续而无行为的继续。继续犯的不法状态，是一种可罚性的不法状态，而状态犯其不法状态，无论继续多久，都是不可罚的。
