释义	法律分析: 根据规定，退休的国家公务员如果因为犯罪而被羁押、被判处管制、或者被判处拘役、有期徒刑宣告缓刑的，停发基本退休金，但是应根据《关于国家机关、事业单位工作人员受行政刑事处罚工资处理意见的复函》规定发放生活费。法律依据: 《关于退休人员被判刑后有关养老保险待遇问题的复函》第三条退休人员被判处拘役、有期徒刑及以上刑罚或被劳动教养的，服刑或劳动教养期间停发基本养老金，服刑或劳动教养期满后可以按服刑或劳动教养前的标准继续发给基本养老金，并参加以后的基本养老金调整。
