释义	法律分析: 在破产法中，能先于破产债权得到清偿的债权均属优先债权，如债权人对债务人所享有的有财产担保的债权、受理破产案件的法院所收取的诉讼费用、破产企业支付给清算组织的劳动报酬以及其他破产费用，均属于优先债权。只有优先债权得到清偿后，一般债权才有机会得到清偿。法律依据: 《中华人民共和国公司法》第一百八十七条清算组在清理公司财产、编制资产负债表和财产清单后，发现公司财产不足清偿债务的，应当依法向人民法院申请宣告破产。
