释义	律师解答：口述遗嘱有法律效力，但是口述遗嘱的订立只有在情况危急的时候才可以订立，并且需要有两个以上的见证人在场见证，并且当危急情况消除之后，如果被继承人还可以通过书面或者录像订立遗嘱的，则口头遗嘱就作废。【法律依据】：《中华人民共和国民法典》第一千一百四十三条： (一)无民事行为能力人或者限制民事行为能力人所立的遗嘱无效。 (二)遗嘱必须表示遗嘱人的真实意思，受欺诈、胁迫所立的遗嘱无效。 (三)伪造的遗嘱无效。 (四)遗嘱被篡改的，篡改的内容无效。
