释义	事实婚姻，规定是双方自1994年2月1日之前，就以夫妻名义同居至今，没有办理结婚证，国家承认双方是夫妻关系，构成事实婚姻。事实婚姻出现在“重婚”行为中时有以下几种情况： 1.前一个婚姻是登记婚姻，后一个婚姻是事实婚姻。 2.前一个婚姻是事实婚姻，后一个婚姻是登记婚姻。 3.前一个婚姻是事实婚姻，后一个“婚姻”是与他人以夫妻名义同居生活。法律依据：《中华人民共和国刑法》第二百五十八条有配偶而重婚的，或者明知他人有配偶而与之结婚的，处二年以下有期徒刑或者拘役。
