释义	婚内提起离婚诉讼的，在提起关于离婚诉讼的时候，无过错方可以要求过错方支付精神损害赔偿。因一方重婚、实施家庭暴力等过错导致夫妻感情破裂的，法院可以判决离婚。同时可以根据过错方的过错程度、造成的后果和本地区平均生活水平等因素，酌定判决精神损害赔偿。【法律依据】《中华人民共和民法典》第一千零九十一条有下列情形之一，导致离婚的，无过错方有权请求损害赔偿： (一)重婚； (二)与他人同居； (三)实施家庭暴力； (四)虐待、遗弃家庭成员； (五)有其他重大过错。
