释义	股票诈骗是属于诈骗罪的一种情况。依据我国刑法的规定，诈骗公私财物数额较大的，处三年以下有期徒刑、拘役或管制。数额巨大或者有其他严重情节的，处三年以上七年以下有期徒刑，并处罚金。数额特别巨大的，或有其他特别严重情节的，处十年以上有期徒刑、无期徒刑。依据相关司法解释，诈骗公私财物3000至1万和3万至10万以上、50万元以上的，分别可认定数额较大，数额巨大，数额特别巨大。那么在量罪定刑的时候，会按照相应的层级进行界定，进行刑事处罚。
